Is ICHRA legal and ACA-compliant?
Yes. ICHRAs were created by federal regulation effective January 1, 2020, and are fully ACA-compliant. For applicable large employers (50+ FTEs), an ICHRA that meets affordability standards satisfies the ACA employer mandate — avoiding both §4980H penalties.
What's the minimum I can contribute?
There is no federal minimum contribution. You can start at any amount that fits your budget — even $100/month per employee is a legitimate, tax-free health benefit. There are also no maximum limits, unlike QSEHRAs.
Do I have to offer it to every employee?
No. IRS rules allow 11 defined employee classes — including full-time vs. part-time, salaried vs. hourly, and employees in different geographic areas. You can offer ICHRA to one class and a traditional group plan to another, as long as the classes don't overlap.
What if an employee can't find a good plan in their area?
ACA-compliant individual plans are available in all 50 states, both on and off the Exchange. Employees who cannot find a plan they consider affordable can opt out of the ICHRA and may qualify for premium tax credits (subsidies) on the Exchange instead.
What if an employee doesn't want to shop for their own insurance?
Employees are never required to participate. Those who prefer not to can opt out once per plan year. However, most employees find the ability to choose their own plan — including plans with their preferred doctors and medications — far more valuable than a one-size-fits-all group option.
Will this affect my payroll system?
ICHRA reimbursements are processed outside of payroll through a third-party administration platform. They are not subject to payroll taxes (FICA) for either the employer or employee. Your payroll system does not need to change — the administration platform handles verification and reimbursement in the background.
What happens if an employee loses their individual coverage?
ICHRA reimbursements can only be made for months in which the employee has qualifying individual coverage. If an employee's coverage lapses, reimbursements stop for that period. The administration platform monitors this as part of the substantiation process.
Is ICHRA subject to ERISA?
Yes — ICHRAs are group health plans subject to ERISA. This means you'll need a formal plan document and Summary Plan Description. ICHRA administration platforms typically provide these as part of their setup process, so this is handled for you.
