Is ICHRA legal and ACA-compliant?

Yes. ICHRAs were established by federal regulation in 2020 and are fully ACA-compliant. For applicable large employers (50+ FTEs), it satisfies the employer mandate when the allowance meets affordability standards.

What's the minimum I can contribute?

No federal minimum. Any amount that fits your budget. Even $100/month per employee is a legitimate, tax-free health benefit. No maximum, either.

Will this affect my payroll system?

No. ICHRA reimbursements process outside of payroll through the admin platform. Not subject to payroll taxes (FICA) for either side. Your payroll system doesn't change.

What if an employee can't find a plan in their area?

ACA-compliant individual plans are available in all 50 states, on and off the Exchange. Employees who don't find an affordable plan can opt out of the ICHRA and may qualify for premium tax credits instead.

How much of my time does this actually take?

Under 30 minutes a month for most employers. The admin platform verifies coverage, processes reimbursements, and handles ERISA documentation automatically. You approve. The platform does the work.

Is ICHRA subject to ERISA?

Yes — ICHRAs are group health plans subject to ERISA. The admin platform generates the formal plan document and Summary Plan Description automatically as part of setup, so the paperwork is handled.
